[6] Philip of Novara understood that this assise predated the assise de la tenure d’an et jour. The evidence for most of the établissements and assises is provided in lawbooks written after 1187. The authors of these appear to have been careful to distinguish from custom the laws they believed were the products of legislation. Philip of Novara, Le Livre, pp. 118-20, 179; John of Ibelin, p. 684. When they were certain, they used the term assise and when uncertain the phrase assise or usage.
