text: Aug. 22. Narni. Pope Honorius III recalls for the patriarch of Jerusalem and the archbishops of Caesarea and Nazareth Pope Innocent III’s judgement in relation to Tyre, where the Venetians and their vicarii had been exceeding their rights and extending their parochial demands over all living in their third of the city. Innocent had subjected the Venetian church in Tyre to the archbishop, but Patriarch A. of Jerusalem, the papal legate, had died before putting this into effect. The Venetians had tried to claim that the court of appeal in this instance was the patriarchate of Jerusalem, not the papacy. The pope had asked the patriarch, the archbishop of Caesarea and the abbot of Mt Tabor to enforce the judgement, but with Innocent’s death and the abbot’s replacement, Pope Honorius adds the archbishop of Nazareth to the judge delegates who are ordered to enforce the judgement.

He confirms their religious life according to the rule of St Basil and their possessions, which he specifies as follows. In Jerusalem they have the place [locus] in which the monastery is situated, together with the church of St Theodosius with a hospital [hospitale], shops [apothece], an oven, vineyards in the 2 monasteries of St John the Baptist and St George; lands at Ramla; lands and a vineyard with a hospital at Ascalon [Scalona]; outside Jaffa the church of St Jonah and within the town shops [apothece] and a hospital with a large vineyard; the right to have 2 ships free [of dues] in the sea off Jaffa; an obedientia at Zevel, together with the church of SS. Peter and Paul and all the market place [forum] with shops [apothece], and a hospital, and a casale. On the island of Cyprus they have the monastery of St Theodosius, which is called de Acra; the tenements [tenementa] called Tromachii with a mill and vineyards; lands at Perdica; the church of St Cassian with its tenements; the church of St George with its dependencies; the tenements called de Glifeo and Geratium; the church of St Alexander with its tenements; at Pissurum the church of St Michael the Archangel with a casale and tenements; the church of Sancta Crux de Aletorum with a casale and tenements; the lands of de Ru and de Virsu; Petra Remei and the seashore as far as Geratum with a fishery and lands; the obedientia de Cay flumine with lands as far as the road; the church of Sanctus Georgius de Pirgo with an olive grove, woods and lands called Corrigee, and the church of St Michael the Archangel; all the terrae de Caumate; the obedientia de Paleopafo with a mill, lands and apple orchards; the church of Sancta Maria de Paracellis with a casale and lands; the church of Sancta Maria de Magnacomis with a casale and tenements extending as far as half of the vineyards of St Sabas, where there is a spring [fons]; the obedientia de Palemedia with lands and olive groves; at Limassol [Nemesium] the apple orchard de Ambuti with lands, a house and a vicus; the obedientia called Kississa with vineyards and lands; at Leotumbis a house and a large vineyard; at Nicosia [Leocosia] the church of St Nicholas with a hospital, apple orchard and lands. There then follows a list of properties in Hungary. Since the Greeks [Greci] were not accustomed to pay tithes, the pope grants the monastery freedom from the payment of tithes on lands held before the Fourth Lateran Council, which the monks cultivated themselves or provided animal fodder, but tithes will be payable on lands acquired after the council that will be farmed by others. The monastery may receive postulants. The diocesan bishop will be responsible for providing chrism and other holy oils, the consecration of altars and churches and ordinations. The monks are freed from observance of interdicts. Crime is forbidden within enclosure. The election of abbots should be free.

Pope Honorius III forbids bishops to impose ecclesiastical sanctions on the churches of the canons of the Holy Sepulchre in disputes over property and he confirms for the prior and convent of the Holy Sepulchre their freedom from tithes with respect to lands held by them before the Fourth Lateran Council. In a second letter he confirms the privileges granted by Popes Honorius II, Innocent II, Celestine, II, Lucius II, Eugenius III and Alexander III, taking the church of the Holy Sepulchre under papal protection, confirming the canons’ adherence to the Rule of St Augustine, and their possessions, specifying: half of all oblations offered to the Holy Sepulchre; oblations to the True Cross, except on Good Friday and when the patriarch needs them; the tithes of the city of Jerusalem and all the diocese, given by Patriarch Arnulf; land in in the new town [in novo burgo] of Nablus, given by King Amalric, and the church the canons built there with the agreement of Patriarch Amalric; houses and lands in the same city; the tithes of a casale called Derina and of a viridarium that is between the wall of Tyre and the forewall, given by the late Petrus Tyrensis archiepiscopus; the casalia of Bethel, Hudemamel, Dersabe, Huodabes and Dermesur, bought from Hugo de Hibelino; the casalia of Betatap and De Rasen, with their guastine and dependencies, bought from Johannes Gothmanni; the casale called Geladia, which King Amalric when count of Ascalon gave in recompense for the expenses of the canons in the capture of Ascalon; the 2 casalia of Cafarup and Vetus Bethoron and the guastina of Derfres, which were acquired in an exchange with the abbot and monks of St Sabas; the land within and outside the city of Old Haifa [Vetus Caypha] given by Vivianus dominus Cayphe with the agreement of his son Paganus; the house the canons built there and the land which the 2 brothers Rogerius and Johannes gave; the church and tithes of that land and its animals, conceded by Ern[esius] Cesariensis archiepiscopus and confirmed by charter; the church of the Holy Sepulchre in Acre; the casale called Mimas with 2 carrucate terre, given by Lambertus; 2 carrucate terre given by Giraldus de Cunin; the garden that had belonged to Mainardus de Portu, given by his son Raimundus when he became a confrater [frater] of the Holy Sepulchre; the 2 casalia of Gebul and Hecar, together with fishing rights for 8 days on the Sea of Galilee, the angaria [of the fishermen] for one day and a boat [navis], given by Willelmus de Burgis and confirmed in a charter by his son Gualterius princeps Tyberiadis; the house and lands in Calcalia given by Fredericus, a confrater [frater] of the Holy Sepulchre, and confirmed by Bartholomeus, dominus of the villa, who added 1 carrucata terre; all the houses in the city of Jerusalem confirmed by the king [Amalric]; the house bought from the archbishop of Tyre. The pope also confirms the right of the prior and canons of the Holy Sepulchre to celebrate stational Masses at and to process to the Templum Domini, the Mt of Olives, Mt Sion and St Mary of the Valley of Jehoshaphat on their feasts, even when the patriarch is absent. They also have the right, in the patriarch’s absence, to excommunicate malefactors in their parishes, especially those who withhold the payment of tithes. None of their goods can be alienated or pledged, except by the common agreement, or that of the wiser part, of the canons; nor can anyone be sent overseas, suspended or expelled, unless his fault is manifest. Confratres can receive communion from the canons and be buried in the canons’ cemeteries unless they are excommunicated. The patriarch cannot extort goods from the canons and confratres. The canons are freed from payment of tithes on noval lands, cultivated by themselves or at their expense, or providing animal fodder. The election of priors by the canons is to be free from interference.
