[244] In the letter Laudabilem Pope Celestine III answers questions posed by the bishop of Acre [Acon.ep.] [245] in relation to marriage, stressing throughout the need for proper procedures on testimony and proof. He discusses: (1) the legitimacy of a marriage to the daughter of a godfather; (2) couples who separate and the need for judgement in such a case by the church authorities; (3) the legitimacy of the marriage of a girl betrothed before the age of puberty and the importance of consent to consummation at the age of 12; (4) the conflict between a vow of chastity and a later vow of marriage; (5) the prohibition of the marriage of Sarraceni, converted to Christianity, to the women whose husbands they have killed while imprisoned by the Christains; (6) women who seek divorce when they discover that their second husbands, either Sarraceni who have converted to Christianity or Christians, have killed their first husbands in battle; (7) the indissolubility of the first marriage of a Christian who temporarily denies Christ and copulates with a pagan and has children, while the Christian wife left behind has a second marriage, with the consent of the archdeacon [of Acre], and has children; and the legitimacy of the children of both second marriages, one of which had been permitted by the archdeacon, provided the man’s first wife has died: (8) the period of time without consummation [3 years] that would dissolve a marriage; (9) a woman given under age to a nunnery by her parents, who receives the habit, leaves, has sexual relations with a knight and becomes pregnant, and is then forced to return to the religious community. text: Dec. 15. Lateran. Pope Innocent III orders the patriarch of Jerusalem, the archbishop of Tyre and the bishop of Acre to release the Knights Templar from a sentence of excommunication improperly imposed on them by the bishop of Sidon. The bishop of Tiberias had complained that the magister and brothers of the militia Templi had held back 1300 besants and other goods of his diocese, which his predecessor had deposited with them. The pope had appointed the bishops of Sidon and Biblium as judge delegates in the case, but the Templars had sent some brothers to inform him that when they disembarked on a Wednesday at Tyre, having returned from the principality of Antioch where they had been involved in a war between the prince of Antioch and the [Muslim] lord of Aleppo, the bishop assigned the following day, the Thursday, for a hearing of the case. The magister could not attend but sent 2 brothers, who promised to respond to the complaint of the bishop of Tiberias and to observe any sentence delivered by the bishop of Sidon, even though the bishop of Biblium was absent. But the bishop of Sidon refused to hear any arguments and demanded the return of the besants to the bishop of Tiberias by the following Sunday; otherwise he would excommunicate all the Templars, in the West as well as in the East. The 2 brothers hurried to Acre and the magister appealed to the patriarch to settle the case and avoid scandal. But on the following Sunday the bishop of Sidon solemnly and publicly excommunicated the whole Order in the church of the Holy Cross in Tyre. The pope orders the patriarch to look into the matter and, if the bishop of Sidon is guilty, to suspend him from office until the papacy lifts the suspension and to absolve the Knights Templar. text: Oct. 25. Lateran. Pope Innocent III records that Pope Alexander III had given the late Simon prior Sancto Georgii de Xisto the right to use the [episcopal] ring, staff and mitre. St George was later subjected to the church of St Thomas the Martyr in Acre, so that the right was enjoyed by whomsoever was prior. This was confirmed by Innocent himself. The bishop of Acre had questioned this extension of the privilege and the case was heard in the Holy See. Innocent upholds the bishop’s complaint. text: Jul. 10. Lateran. Pope Honorius III writes to the patriarch of Jerusalem, the bishop of Acre and the cantor Acconensis in relation to the case of magister Willelmus clericus. He had ordered them to investigate whether it was reasonable to instal Willelmus as a canon of the church of Limassol on the basis of the grant to him of an asisie, which is worth a little less than a prebend, arguing that there would little to lose and a benefit to be gained. The patriarch, bishop and cantor had found no reason to oppose the instalment, but had suggested that it be postponed. Believing that the wider church will benefit, Honorius orders them to compel the bishop and chapter of Limassol to instal Willelmus in the choir and in chapter. Jul. 10. Lateran.
