comments: [4] Hiestand (PK, pp. 281-3) considers this to be a forgery. Mayer (UKJ 1:115-16) is not so sure, but provides additional reasons why its authenticity should be doubted.

comments: [5] Mayer (UKJ 1:117-18 and in Bistümer, pp. 258-87) has argued at length against any endowment by Godfrey and the establishment by him of a Benedictine community in the Valley of Jehoshaphat. There are reasons – particularly Patriarch Arnulf’s charter of Apr. 6 – Dec. 24 1112 – for questioning the foundation of the Benedictine abbey at such an early date, but the prestigious nature of the shrine and the burial of Garnier of Grez in late July in valle Iosaphat, in porticu basilice sancte Marie virginis et matris Iesu Christi (Albert of Aachen, p. 516) suggests that there was some monastic presence on the site during Godfrey’s lifetime. See Pringle, The Churches 3:288-9.

comments: [6] Philip of Novara understood that this assise predated the assise de la tenure d’an et jour. The evidence for most of the établissements and assises is provided in lawbooks written after 1187. The authors of these appear to have been careful to distinguish from custom the laws they believed were the products of legislation. Philip of Novara, Le Livre, pp. 118-20, 179; John of Ibelin, p. 684. When they were certain, they used the term assise and when uncertain the phrase assise or usage.
