Melisende, divina largiente clementia Iherosolimorum regina, with the consent of her sons King Baldwin III and Amalricus Ioppensium comes, renounces under seal her claims against the canons of the Holy Sepulchre, with respect to the villani of Bethsuric, namely Selmen filius Maadi; Habderahmen; Selim; Hasem; Nasen; Mekedem/Melpedem/Melpeclem; Seleemen; Sade; Brahin; Kannet; Nasser; Ariz; Mahmut; Zafer; Demsis; Resselem; Tameh; Rosec; Sahe; Salem filius Sade and the others, and the land in the casale. The canons are to have these as freely as they did in the time of Duke Godfrey [of Bouillon]. Melisende confirms the canons’ rights over the Suriani of Kalandria called Cosmas, Semhan/Seimahian, Samuel, Ihanna, Meferreg and Gerges, in exchange for a statio, which had belonged to Willelmus Bastardus, and the shares the canons had in 2 tables of money-changers [mensae nummulariorum] so that Melisende could construct a new ruga in Jerusalem. Melisende also renounces claims she had had on Suriani of Ramathes, called Bolferag, Jacob, Brahim and Ysaac, and on a vineyard that domna Geltidis, the wife of the lord Rohardus had left as an eleemosynary gift on her death. The properties are sold for 7,000 besants and are freed from all servicium dominium. Amalricus comes Ascalonis makes a sealed eleemosynary grant, confirming for the canons of the Holy Sepulchre, represented by Hugo dictus de Tharso, decanus Joppensis, the sale for 52 besants to Hugo of a pecia, consisting of two parts of a vineyard, by a Surianus called Naym. Amalricus gives the third part of the vineyard, which had belonged to him, to the decanus and brothers of the Holy Sepulchre, to which he adds whatever belonged to him in the vineyard of the Surianus Menferretus. The 2 pecię were next to the vineyard of the Holy Sepulchre on the eastern side. In return for this Hugo makes a counter-gift to Amalricus of 100 besants. Hugo de Ybelino, with the consent of his brothers Balduinus and Barisanus, his sister Hermengardis, his mother Alois and his uncles Philippus de Neapoli, Guido Francigena and Henricus Bubalus, sells to the canons of the Holy Sepulchre Huetdebes with its villani and Deirmugsin with its villani, which Hugo’s father Barisanus had given to Muisse Arrabit and his son Georgius and which had then been willingly exchanged by Muisse Arrabit and Georgius. Hugo, forced by the need to pay ransom for his release from captivity, sells the casalia, freed from all servitium dominium, for 3000 besants. Hugo’s brothers Balduinus and Barisanus, his mother Alois, his sister Hermengardis and his uncles Philippus de Neapoli, Guido Francigena and Henricus Bubalus, together with his relations [cognati] Philippus de Cafran and his brother, and Petrus de Teillei agree to the sale. On behalf of minors, Hugo’s sister Stephania and the heirs of Arrabit and his son Georgius, Hugo de Hybelino, his brother Balduinus, and Hugo’s homines, Muisse Arrabit and his son Georgius, Symon de Haia, Ordelet and his son Stephanus, Adam de Orgeol, Nicholaus de Hybelino, Hosmundus, his brother Radulfus, Lebertus, Paganus de Rohais and Philippus de Cafran swear to be guarantors and will go to the chapter of the Holy Sepulchre to confirm the sale within a year. If there is any reduction in what is due Hugo will answer to the Holy Sepulchre in Jerusalem within 15 days of a summons to remain as hostages. The sale is agreed by Amalricus comes Ascal[onis], in whose feodum the casalia lie, and who has sealed it, because Hugo has no seal. Amalricus comes Ascalonis, with the consent of his brother King Baldwin and the agreement of his mother Queen Melisende, makes a sealed eleemosynary grant to his confratres the canons of the Holy Sepulchre in return for their contribution to the expense of capturing Ascalon. He gives the Holy Sepulchre a casale called Geladia/Geliadia with 16 carrucatę terrę, marked out by his homines, and a house in Ascalon. With the agreement of Patriarch Amalric, he also gives 2 carrucatę terrę in the casale called Baineolbederan in exchange for the mahumeria called by the Sarraceni Cathara and the Latins ‘Green’, which had been given to the Holy Sepulchre after the capture of Ascalon. He confirms the alms-gift to his confratres the canons of 4 carrucatę terrę over [super] the river before Jaffa, a garden before Jaffa, a vineyard next to it and another vineyard, together with whatever the canons hold legitimately in the territories of Ascalon and Jaffa. text: Before Jul. 16. [101] Vivianus dominus de Cayfa, with the consent of his wife Beatrica, his son Paganus, and Hodierna the wife of Paganus, makes a sealed eleemosynary grant to the canons of the Holy Sepulchre, giving them a locus in a deserted villa, situated between Cayfa and Palmarea. The property [extends] next to the upper road [superior via] from the ancient gate of the villa facing Palmarea as far as a stone, establishing a boundary beyond the middle of the villa [ultra mediatatem ville pro termino fixum], and from that stone as far as a stone, inscribed with a cross, over the carob tree plantation [carublerium]. It then runs from the stone with the cross over a hill as far as a cava [per collem usque ad fundum cave]. There are ancient tombs within these boundaries. He gives all the land and its level ground from the villa along the public road as far as 2 carob trees, recognizing that the land has been ill-used and is invaded by thorns and denser carob thickets, as far as the large cava from which water flows into Palmarea. His gift is bounded in a straight line from the great cava to the other cava in the deserted villa near the canons’ building, and as far as the top of the mountains. Vivianus adds the gift of a garden within Palmarea, which contains 2 cisterns. His gifts will be freed from all exactions and customs. The canons are free to buy or sell moveables or take out or bring in necessities for their house wherever they are without the payment of customs or tax [consuetudinaria aut premium], but they cannot buy houses and lands without the lord’s licence and they must retain gifts ‘for a year and a day’.
