Pope Innocent III has been informed by G. de Montebiliardi regni Iier[oso]l[im]itani comestabulus et Cypri regis tutor et bajulus regni [Cypri] that there had been an agreement between the late King Aimery of Cyprus and comes Henricus Ier[oso]l[im]itani regni dominus on the marriage of their sons and daughters, and over the county of Jaffa. Replying to queries from the patriarch of Jerusalem, Pope Innocent III declares: (1) that priests who arrive in the East and cannot provide letters or testimony of their ordination should not be permitted to say Mass; (2) that priests and religious who have absconded and have adopted secular dress are not to be tolerated, unless they can prove that they have already been punished; (3) that he leaves the issue of clergy who have committed crime or irregularities or who, together with debtors, have sought sanctuary with the Knights Templar or Hospitallers of St John, to the patriarch, who knows the law. text: Jan. 9 Rome. St Peter’s. Pope Innocent III writes to the patriarch of Jerusalem, the papal legate, concerning a case being heard in Rome, involving magister Iohannes and P. the emissary of the patriarch of Antioch, who had protested over the actions in Syria of the papal legate Cardinal Peter of St Marcellus. On hearing that the archdeaconry of Antioch had been vacant for more than 6 months, Cardinal Peter had ruled that provision had devolved on the Holy See and had granted the archdeaconry to magister Iohannes. The patriarch had responded that he had already offered the office to his nephew and refused to carry out the instructions of the cardinal, who was now in Tortosa [Antaradus]. Cardinal Peter, asserting that the nephew was anyway under age, confirmed his own decision and appointed the prior Bellimontis and magister Milo to instal magister Joannes in the choir and chapter and confim him in his benefices. And, knowing that other canonries were vacant, he had assigned 2 to the clerics Rog[er]ius and Barth[olome]us. The dispute came to involve the bishops of Tripoli and Tortosa [Antaradensis], Marinus Nicociensis archidiaconus and the bishop of Valenia [Valaciensis episcopus] and the journey of W. quondam archidiaconus Antiochenus and the 2 canons to Rome. It culminated in appeals to the Holy See. The patriarch himself pointed to the damage his church had suffered from the prince and citizens of Antioch. He asserted, moreover, that the new archdeacon was uncanonically appointed, because he had been a monk of the abbey of the Holy Spirit at Palermo.
