Petrus prior Dominici Sepulcri records that, together with some of his canons, he travelled from Jerusalem to Antioch to investigate the rights enjoyed by the church of the Holy Sepulchre in the time of the Greeks [Greci] and then under the Turks [Turci]. He found 2 mills, one standing, the other ruined, on the banks of the River Orontes at the head of the bridge leading to the Gate of the Count [of the city], which the Holy Sepulchre had once owned by hereditary right. Having investigated the matter with lord Raymond [of Poitiers], princeps ejusdem civitatis, and husband of Constantia and having taken evidence from elderly Suriani, it was agreed to put the 2 water wheels [duas rotas a parte fluminis] at [one of] these mills, called Funeidec, into the custody of three Suriani called Nicheforus, Michaelis and Nicholas for them and their heirs to hold in feodo villaniᶒ on condition that they meet the expenses in materials required in rebuilding the mill and the barrage [exclusa] for the mill race. In return they will have half of all the profit they make from milling and from fishing, although the division of produce between them and the Holy Sepulchre will only take place in the presence of the canons’ famulus, who will hold the key to the mills. If the mill should be damaged the Syrians will rebuild it; on a third refusal to rebuild the mill will be confiscated. If a miller is convicted of theft he will repay either in marcibans or in besants. If he cannot repay the money will be expropriated by a canon or by the canons’ famulus. The villania cannot be sold or pledged without the permission of the chapter of the Holy Sepulchre. Frater Gaufridus magister Hospitalis records that he had asked Bohemond, princeps Antiochie et comes Tripolis, to confirm the possession by the Hospital of St John of Jerusalem of a land before Befania. The Hospitallers had released the prince from [his obligation to] the heir of Guillelmus Porcelet, when that heir came of age. If in future the heir should challenge this and the court should judge [per judicium curie] that the land should be returned to him, the Hospital would restore it. The boundaries of the land are as follows. On the east it borders land of the Hospital and land that had belonged to Georgius Porcellet. On the south there is the rivus de Gerol .... On the west it borders the Rivus Vetus, which flows when it rains. It adjoins the same river to the north. Stones are placed on each of the four corners of the land. Bartholomeus Valloniensis ecclesie minister humilis records under seal that Pope Gregory IX has appointed him judge delegate in the case that has arisen between the magister and brothers of the Hospital of St John of Jerusalem and Bohemond, prince of Antioch and count of Tripoli, over Maraclea and other injuries. Bohemond did not answer several summons by the bishop to appear in Antioch, nor did he provide adequate response. On a further peremptory summons, he sent to Tortosa [apud Anterandum] as his representative M. thesaurarius Anteradensis, who was not sufficiently provided with letters and denied the bishop’s authority in this case. The prince renewed the appeal [to the Holy See] he had already made in the presence of the patriarch of Antioch. Since the magister and brothers of the Hospital were demanding action, the bishop took advice in Acre and travelled to Margatum where he waited until 22 November for the prince to answer the case. He then judged that the magister and brothers of the Hospital of St John, who were represented by the procurators magister Robertus de Alvernia clericus domini archiepiscopi Nicosiensis and Robertus Pisanus judex, filius quondam Maregnani cancellarii, be put in possession and into provisional lordship [quasi dominium] of the castle of Maraclea. He called on the procurators to appear before him at Margatum on 15 January next to describe the injuries suffered by the Hospital at the hands of the prince.
