The Prince-count of Antioch-Tripoli has appealed on legal grounds for a renewal of his case against the magister and brothers of the Hospital of St John of Jerusalem over the castle of Maraclea. This was first arbitrated by the Valaniensis episcopus and then delegated by the papacy to the archbishop of Tyre, bishop-elect of Sidon and the archidiaconus Sydoniensis. The pope now orders the patriarch of Jerusalem, the archbishop of Tyre and the bishop of Beirut to terminate the case. Feb. 11. Lateran. Pope Gregory IX draws attention to the reference made at the Holy See by the bishop of Acre, in dispute with frater Andreas de Fogia, the procurator of the Hospital of St John of Jerusalem, to the agreement between J. episcopus Acconensis and the magister and brothers of the Hospital of St John, arbitrated by Cardinal Pelagius of Albano and recognized by both parties. 2 articles in this agreement, regarding exemption from tithes on the casalia commonly called Broet and Coket, and on sugar cane, as opposed to wheat and barley, at the casale of Manuet need further definition. The patriarch of Antioch has complained that Prince Bohemond [V] of Antioch has refused to receive investiture of Antioch from him or take the customary oath of fidelity to the church, which he is injuring in violation of the terms of the agreement reached with his father Prince Bohemond [IV]. He has denied the rights of jurisdiction of the castellanus castri Cursarii, an official of the church, who had condemned the murderer of a priest to death, and has challenged the jurisdictional rights of the church.
