comments: [201] The judgement, surviving only in inventories of the 16th and 18th centuries, has attracted some discussion. See for example Hiestand, PTJ 2 :295; Hamilton, The Latin Church, p. 81; Kedar, ‘The Patriarch Eracles’, p. 181; Edbury and Rowe, William of Tyre, p. 22 n. 33. So many questions arise that I am inclined to believe that it is, at least, very corrupted. William of Tyre probably died in 1184. The Hospitallers did not acquire Margat until – at the very earliest - late 1186. Why was a judgement relating to a diocese in the patriarchate of Antioch decided by judge delegates from the patriarchate of Jerusalem, in the presence of the patriarch of Jerusalem and dated by the regnal year of the king of Jerusalem?

Amalricus vicecomes Neapolis records under seal the ending of a long dispute between him and the abbey of St Mary of the Valley of Jehoshaphat over the boundaries of land, which is above Kafrecos. With the agreement of his wife Theophania he orders and assents to a drawing of the boundaries by 3 probi homines of Nablus, dominus Bernardus Pelliparius, dominus Wido de Escar and dominus Georgius Cambitor. The boundary [divisiones et metae] is marked as follows. It runs below the wall of the vineyard of Basinus to the vineyard of Gilelmus Brito and then by marks, set on the hillside to the cavea Medequen and the vineyard already named, descending as far as the mills. Amalricus surrenders all the land within the boundaries on the eastern side as far as ima Vallis Abrahae. Pope Clement III commissions A[delardus] Ueronensis Romane ecclesie cardinalis, [Monaldus] Fanensis episcopus and [Bonifacius] abbas Nonantulanus to be judge delegates in a dispute between the archbishop of Tyre and the plebanus of the Venetian church of St Mark in Tyre about that church’s rights in the Venetian third of Tyre. The rights that are claimed include the parochial ones of baptisms, hearing confessions, burials in the Venetian third of the city cemetery of St Michael, with its entrance from the Venetian section of the city, tithes, schools, marriages, the purification of women and the possession of spolia. The case had arisen in the pontificate of Alexander III and had been heard in the Lateran by Cardinals Teodinus and Hugo, but without resolution. Aug 11. Lateran. These had been confirmed for the time being, while the Holy Land was not recovered, by Pope Clement III, who had authorized the archbishops of Caesarea and Nazareth and the prior of the Holy Sepulchre to settle the matter. [257] Bohemond, the son of Prince Bohemond of Antioch, Dei gratia Tripolis comes, records an agreement with Matheus Minchet vicecomes Pisanorum Tripoli, and Gandulfus, Bandinus and Ugo, emissaries [nuncii] of the consules of the Pisans in Acre. Petrus Tripolis episcopus had challenged the rights of free entry and departure with merchandise from Tripoli and the exemption of a third part of terciaria. The Pisans had claimed that the count had no rights in the funda of the Pisans in Tripoli or over the entry or departure from Tripoli with merchandise. Bohemond confirms that the Pisans already had these rights and receives in exchange a gift of 500 Saracen besants. Pope Innocent III rebukes the magister and brothers of the Hospital of St John of Jerusalem for resorting to force in their dispute with the Knights Templar over possessions in Margatum and Valenia, expressing disgust at Christians, especially those accustomed to fight Saraceni, taking up arms against one another. The Hospitaller brothers Disigius prior Baroli and Og[erius], preceptor Italie and the knights Templar [fratres militiae Templi] Petrus de Villaplana and Terricus have appeared before the pope, with testimony from peregrini and bishops from overseas. With the consent of the miles Seguinus, the pope judges that the possesssion should be returned to the Templars. But after holding it for a month they should then respond to the plea of Seguinus in the Hospitallers’ curia [at Margatum], to which should be assembled suitable men from the principality of Antioch and the county of Tripoli, who are acceptable to the Templars. The decision will be enforced by the patriarch of Antioch, the archbishop of Nazareth and the bishop of Valenia.
