Baldwin, per gratiam dei in sancta Iherusalem Latinorum rex quartus, with the assent of Queen Melisende his mother and Amalricus comes Ascalonitanus his brother, confirms as a sealed eleemosynary grant the exchange made in the time of his father Fulk rex Iherosolimorum illustris, in which Johannes Patricius recorded that he had exchanged 2 of his casalia, called Megina and Mezera, for 2 casalia, called Caphermelich and Anquina, which belonged to the Holy Sepulchre. He made this exchange with the consent of Babinus from whom Johannes held his feodum and in the presence of King Baldwin and Queen Melisende. The exchange made by Johannes had been approved by his relation [cognatus] Petrosus, his wife Bruna, and his sons Thomas and Eustachius. A condition of the exchange was that if Johannes or his heirs infringed the rights of the Holy Sepulchre, such damage would be made good. Since disputes had arisen in the reign of King Fulk over the exchange, its terms are now confirmed. Baldwin, per gratiam dei in sancta Iherusalem Latinorum rex quartus, confirms under seal the renunciation made by his mother Queen Melisende, with the consent of his brother Amalricus comes Ascalonitanus, of her claims against the canons of the Holy Sepulchre, with respect to the villani of Bethsuric, namely Selmen filius Maadi; Habderahmen; Selim; Hasem; Nasen; Mekedem; Seleemen; Sade; Brahin; Kannet; Nasser; Ariz; Mahmut; Zafer; Demsis; Resselem; Tameh; Rosech; Sahe; Salem filius Sade and others, and the land in the casale. The canons were to have these as freely as they did in the time of Duke Godfrey [of Bouillon]. Melisende confirmed the canons’ rights over the Suriani of Calandria called Cosmas, Semhan, Samuel, Ihanna, Meferreg and Gerges, in exchange for a statio, which had belonged to Willelmus Bastardus, and the shares the canons had in 2 tables of money-changers [mensae nummulariorum], so that Melisende could construct a new ruga in Jerusalem. Melisende also renounced claims she had had on Suriani of Ramathes, called Bolferag, Jacob, Brahim and Ysaac, and on a vineyard that domna Gislia, the wife of Rohardus, had left as an eleemosynary grant on her death. Baldwin per gratiam dei in sancta Iherusalem Latinorum rex quartus makes a sealed eleemosynary grant to the church and canons of the Holy Sepulchre, confirming gifts made by himself and by previous kings. Godfrey dux [of Bouillon] gave 21 casalia: Ainquinę; Armotię; Kefreachab; Kefredil; Bubil; Hubin; Aram; Kalendię; Betdigge/Beitligge; Birra/Byrra; Subahiet; Ataraberet; Vrniet; Zenu; Helmule; Beutelamus; Barithmeta; Beitiumen; Beitfoteire/Beitfuteier; Betsuric/Betsurit; Aineseins; and all the ovens in Jerusalem, except for 2 belonging to the Hospital of St John and 1 belonging to St Mary of the Latins. King Baldwin I gave villani and their families at Sanctus Lazarus [Bethany] and the 4 casalia above Sanctus Lazarus of Benehatię, Benehabeth, Ragabam and Roma; 1000 modii of wheat each year in the territory of Nablus; and half of that property which the king gave the Holy Sepulchre in the exchange relating to the bishopric of Bethlehem. King Baldwin II gave a casale called Derina, situated in the territory of Tyre close to the great spring [fons] that feeds the aqueduct, together with 4 carrucates [quantum quatuor paria boum de anno in annum excolere possunt], situated on the hillside nearby. He excluded from the confirmation another unnamed casale, if indeed it had been subtracted from the territory of the Holy Sepulchre. King Baldwin II also gave a garden situated between the sea wall and sea forewall of the city; a casale named Cafermelech in the territory of Nablus; half of the casale of Fieisse now called Casale Sancti Sepulchri, which was given by Eustachius Granerius, and all the land that Galterius, the son of Eustachius gave around the same casale, beyond the River [Jordan] as far as the designated boundaries that are recognized today. With the agreement of Melisende, King Baldwin III’s mother, and his brother Amalricus, King Fulk gave the casale of Thecua in exchange for Sanctus Lazarus in Bethania. Fulk confirmed the gift by Lambertus Als of 2 carrucate terrę plenarie situated in the territory of the casale of Mimas; the gift of Guillelmus de Buris of 2 casalia called Gebul and Helkar with their lands and the use of their fisheries [piscariae] for 8 days each year, the angaria [of his own fisherman] for one day a year and the use of a boat [navis] in the way specified by Guilelmus de Buris; houses within the walls of the city of Jerusalem, occupied by Petrus Bernardi canonicus, Eurardus canonicus, alterius Eurardus canonicus, Mainardus, Garsio, Galterius Lo Tornaor, Bernardus Bursarius, Herluinus, Mabilia - with a garden situated beside it – and Rogerius de Sancto Lazaro, a confrater of the canons, and the statio of Guillelmus Bastardus together with that share that the same Guillelmus had in the tables of the money changers [in mensis nummulariorum] – this confirmation was an eleemosynary grant; and a house at Acre given by Lambertus Als and Agnes his wife on conditions specified in the charter. Among other confirmations, there were 3 casalia called Capharuth, Gith and Porphiria, which Rogerius Liddensis episcopus gave out of the possessions of [the church of] Sanctus Georgius [Lydda], and a 4th casale called Kefrescilta, which, together with half of the tithes of the harvests of the aforesaid casalia, [Rogerius] Liddensis episcopus gave for the recognition of his right to the tithes of Castellum Arnaldi and of a casale of the Hospital of St John called Bulbul; an exchange made between the canons of the Holy Sepulchre and Iohannes Patricius of 2 casalia, called Caphermelic and Ainquina, for 2 of the casalia of Iohannes, called Megina and Mezera; half of the oblations of the faithful to the Holy Sepulchre; all oblations to the relic of the True Cross, which was in their custody, on all days except Good Friday and those occasions when the patriarch needed to carry the relic with him; two thirds of candle money; the tithes of the whole of the city of Jerusalem and its environs, conceded by Patriarch Arnulf, except for those from funda, which would be enjoyed by the patriarch; the church of St Peter in Jaffa, conceded by the patriarch to the canons; and half the benefice King Baldwin I gave in exchange for the bishopric of Bethlehem. Agnes, the wife of Galius miles, who is now a brother of the Hospital of St John [frater et humilis servus pauperum Iherusalem], makes an eleemosynary grant, giving the Hospital of St John her houses [in Acre], although the Hospitallers allow her to retain for her own use one of them, consisting of a palacium, stables [stabularia], cistern and court [curia]. She presents the gift to Clarembaldus vicecomes Acconensis and [through him] to frater Giraldus Hugonis preceptor totius domus Hospitalis Iherusalem, frater Giraldus magister de Accon and other brothers, including Petrus Amelius capellanus, Antelmus, Berengarius, Pons custos infirmorum and Petrus de Limoges. The Hospitallers promise her in return a life rent of 80 besants a year, payable on the Feast of St Peter at the beginning of August. [72] They add a worked samite cloth [unum samittum ad opus] for her daughter Laureta. If she should wish to leave Acre to live in Jerusalem or in any place in the Latin East, the Hospitallers will add another 10 besants a year according to her station in life, although they will then take possession of all her properties [in Acre]. text: Nov. 2. Acre. Baldwin, per gratiam dei in sancta Hierusalem Latinorum rex quartus, with the advice and agreement of his mother Queen Melisende, seals a peace treaty with the Pisans, who renounce all the claims on confiscated goods that they have brought against him and his homines, except for those relating to their honores that they are pursuing against the patriarch of Jerusalem, the clergy [clericatus] of Caesarea and the abbot and monks of St Mary of the Latins. The king, on his behalf and on that of his homines, renounces all claims and confiscations made against the Pisans. The Pisans promise to keep security and faith [salvum et fidum] with the king. They will protect him and his subjects homines by sea and land and will do their best to prevent other persons harming them. The king makes the same promise of security, protection and faith to the Pisans. King Baldwin excludes from this agreement the sale in Egypt of iron, wood, pitch, [pix] or arms, which can be confiscated without breaching the treaty. The king gives the Pisans a viscounty in Tyre, the holder of which can judge the Pisans in their own court [curia], reserving only to royal justice cases involving death sentences [traditio mortis]. He gives the Pisans 5 carrucate of good land next to Tyre and an oven in Tyre. He confirms King Baldwin II’s grant to the Pisans of 5 houses in the ruga next to the port of Tyre free of rent [tributum vel redditum] and freedom from taxes on their shipping [naves] and goods in the port, although pilgrims and other men (who are not Pisan merchants) would not be exempt. The goods of Pisans who died would not be subject to any restrictions or taxation. Baldwin wishes his brother Amalricus comes Ascalonitanus to make peace with the Pisans.
