text: Jun./Jul. 1109 – Nov. 30 1110. Bertrand, inclitus comes [Tripolitanus], son of Raymond of St Gilles, had made an eleemosynary grant, to benefit the soul of his relation William Jordan [count of Cerdagne], in the presence of King Baldwin I of Jerusalem, the archiepiscopus Albariensis and Arnulfus archidiaconus and other good men. He had made this to the church of the Holy Sepulchre which is situated in the castle [castrum] of Mont Pèlerin and was represented by Johannes, who was prior of the same church. Bertrand had given 3 casalia: Abdin/Addin, Babela/Habela, and Beniharan/Beniaran, but he had unjustly taken the casalia back into his hands. When Arnaldus, elected prior of the church on Mont Pèlerin by the chapter of the Holy Sepulchre in Jerusalem, demanded the return of the casalia, Bertrand, together with his son Pontius acknowledged his guilt. By an eleemosynary grant he returns them to the church. He confirms the gifts made to the church of the Holy Sepulchre on Mont Pèlerin by his father, Count Raymond of St Gilles, and his cousin William Jordan and in addition gives Arnaldus prior a good horse and the best mule that can be found. If Bertrand or Pontius fail in this commitment they will be subjected to excommunication by the patriarch of Jerusalem, the bishop of Tripoli, the archbishop of Apamea [Femia] and the bishop of Béziers. At the request of the abbot and monks of the abbey of St Mary of the Latins in Jerusalem, which was a hospice serving Latins [Latini], Italians and Lombards when Jerusalem was occupied by the Muslims [Sarracenorum Turcorumque temporibus], Pope Paschal II takes them under papal protection. He confirms their Cassinese Benedictine customs and their use of Roman psalmody. He forbids anyone to enter the abbey without the monks’ licence, other than the patriarch of Jerusalem. The abbot’s election will be according to the Benedictine Rule and no Italian is to be forced on the community. The ordination of an abbot is to be the prerogative of the patriarch of Jerusalem if the elect finds travelling to Rome for consecration difficult. No tithes are to be owed on harvests produced by the monks’ own labour or on oblations or revenues granted to the community. The abbey’s cemetery, and the cemeteries attached to its dependent churches, are to be available to those who wish burial, provided they are not excommunicates. Paschal confirms the abbey in its churches and possessions. The abbots may enjoy privileges granted by them by the churches of Jerusalem and Bethlehem. Pope Paschal II writes [in Pie postulatio voluntatis] to Giraldus, institutor ac prepositus Ierosolimitani xenodochii, taking the hospital [xenodochium], situated in the city of Jerusalem next to the church of St John the Baptist, under papal protection. He confirms all acquisitions that have been and will be made by the Hospital of St John of Jerusalem for the sustenance of pilgrims and the poor, including those gifts made by the patriarchs of Jerusalem and others. The Hospital is freed from the payment of tithes on harvests produced at its labour or expense. On the death of Giraldus only the professed brothers may elect his successor. Paschal confirms the Hospital’s right to all its possessions, in Asia as well as in Europe.
