He confirms the gift to the Hospital of the gastina vetus by the miles Godefridus and his wife Albereda, the daughter of the late Ada de Peviers. The gastina adjoins the commandery alongside the public way and is enclosed by a wall. Bohemond also gives the commandery Georgius notarius, the son of Vassilius filii Uardi, and his legitimate heirs, in hominem peculiarem, excepting those properties [hereditates] of which he was already in possession on the day this charter is written. Any future acquisitions by Georgius will be subject to the Hospital. With the agreement of his wife Eschiva, Aimery, Dei gratia dominus Cipri, makes a sealed grant to Petrus abbas Dominici Templi and his canons of a curtis in Nicosia, within which is built the chapel [capella] of St Mary, and a prestia built by his late brother King Guy near the river in the direction of casale Vuillelmi de Balma, with 10 carucate terre around the prestia. The Templum Domini can freely send the wheat [bladum] harvested by the canons’ own labour to the land of Jerusalem. In return the abbot has given Aimery a beautiful ruby [rubinus], weighing 2 and a half besants. text: Sept. 1-30. Acre. Mindful of the magnificent contribution the city of Genoa made to the liberation and defence of the eastern regions and the siege of Acre with milites, pedites, balistarii and sagittarii, and siege engines, and with the consent of his wife domna Ysabella regis Amalrici filia, Henricus, Trecensium comes palatinus Tyri et Accon domnus, makes a sealed grant to the commune of Genoa and its citizens, represented by Gafforius victoriosi stolii Ianuensium amiratus. He confirms their free curia in the city of Acre. They are confirmed in their freedom from prosecution in any curia or in the cathena of Acre for any crime except homicide, theft and rape, and from imprisonment. They are free to come and go by sea or land, to buy and sell in the fundicum or the cathena without the payment of dues. Henricus confirms the Genoese possession of the ruga beati Laurentii in Acre and the freedom of the inhabitants from prosecution. He licenses the Genoese to build a tower in their ruga, should they wish to do so. He gives them the right to complete the building of the church of St Laurence in Tyre and he confirms all their rights in Tyre described in their charter. He promises to return the possessions of Ellena, the daughter of the late Rogerius de Insula, and her husband Ansaldus Bonivicinus within the next 8 days. Henricus, Ysabella, domnus Radulfus de Tabaria regni Ierosolimorum senescalcus, domnus Hugo de Tabaria and domnus Raginaldus Sydoniensis swear to be guarantors of this grant, as do the senescalcus domus militie [Templi] and the magister domus Hospitalis and their chapters. text: Feb. 13. Lateran. Pope Celestine III follows his predecessors Popes Honorius II, Innocent II, Celestine II, Lucius II, Eugenius III and Alexander III in taking Gaufridus prior and the canons of the Holy Sepulchre under protection. He renews their privileges and confirms their endowments. He states that in the absence of a patriarch the prior and canons will be responsible for managing the patriarchal house and familia. He confirms the freedom of prioral elections and the celebration by the prior of the stational Masses at the Templum Domini, Mt Sion, the Mt of Olives and St Mary of the Valley of Jehoshaphat in the absence of the patriarch. The prior and canons also have the right, in the patriarch’s absence, to excommunicate malefactors in their parishes, especially those who withhold the payment of tithes. None of their goods can be alienated or pledged, except by the common agreement, or that of the wiser part, of the canons; nor can anyone be sent overseas, suspended or expelled, unless his fault is manifest. Confratres can receive communion from the canons and be buried in the canons’ cemeteries unless they are excommunicated. The patriarch cannot extort goods from the canons and confratres. The canons are freed from payment of tithes on noval lands, cultivated by themselves or at their expense, or providing animal fodder. The pope also confirms half of the properties held in common with the patriarchate itself in England, Dacia, Germany, Poland, Ruthenia, Georgia [Auagia], Hungary and Constantinople. Feb. 13. Lateran.
