Maccildis, widow of dominus Conradus advocatus de Swarcenberch, makes a sealed eleemosynary grant, to benefit especially the soul of her dead husband, to the Hospital of St Mary of the Germans in Acre. She gives her house, which she and her husband bought from the daughter of the late comes Joscelinus. She also sells the land [attached to the house], for which frater Hermannus hospitalis magister and his brothers promise to deliver 400 marks of pure silver to her at Strasburg [Straceburch] within 15 days after Pentecost in the following year or, if they do not, to pay an annual rent of 40 marks until the sale price is settled. They assure her that she may continue to enjoy the revenues of the land during her lifetime. After her death it will pass fully to the Hospital. He gives a free court [curia libera] in the city of Antioch and throughout the principality, so that the curia Ianuensium and the vicecomes at that time established by the commune of Genoa shall judge all cases relating to those who call themselves Genoese, except for theft and homicide. He gives the Genoese freedom to come and go, buy and sell, without paying dues [de omnibus draituris et de omni passagio] in Antioch and in all the land he can recover or acquire, except in the port of Sanctus Symeon. He confirms the Genoese possession of the vicus Sancti Iohannis de Platea and a third part of the port of Sanctus Symeon and all other properties in the principality of Antioch. With the agreement of his wife domina Heluisa principissa and his uncle King Leon of Armenia, at the request of his brother-in-law [sororius] King Hugh of Cyprus, and with the advice of his homines, Raymond Rupen, Dei gratia princeps Antiochie, the son of Prince Raymond, makes a sealed confimation to the Pisan commune and all Pisans. He confirms their possessions and rights in the principality of Antioch, including all gifts made by his grandfather Prince Bohemond of Antioch and Bohemond’s mother Princess Constantia. He confirms the Pisans’ right to have a court with jurisdiction over Pisans in all cases except theft, homicide and treason against Raymond Rupen’s person, which are reserved to his court. He grants full rights to buy and sell, enter and leave free from the payment of all dues relating to buying and selling [omnibus drecturis cabani totius passagii et quirati et commercii] imposed by his baiuli, pautonarii, secretarii and others, with the exception of those of the port of Sanctus Symeon, where the Pisans should pay half passagium, half tercenaria portus and half ancoragium, and half of all other dues, but are freed in the port from paying tax on purchases and sales relating to the commercium of Antioch. In Jerusalem they have the place [locus] in which the monastery is situated, together with the church of St Theodosius with a hospital [hospitale], shops [apothece], an oven, vineyards in the 2 monasteries of St John the Baptist and St George; lands at Ramla; lands and a vineyard with a hospital at Ascalon [Scalona]; outside Jaffa the church of St Jonah and within the town shops [apothece] and a hospital with a large vineyard; the right to have 2 ships free [of dues] in the sea off Jaffa; an obedientia at Zevel, together with the church of SS. Peter and Paul and all the market place [forum] with shops [apothece], and a hospital, and a casale. Since the Greeks [Greci] were not accustomed to pay tithes, the pope grants the monastery freedom from the payment of tithes on lands held before the Fourth Lateran Council, which the monks cultivated themselves or provided animal fodder, but tithes will be payable on lands acquired after the council that will be farmed by others. The monastery may receive postulants. The diocesan bishop will be responsible for providing chrism and other holy oils, the consecration of altars and churches and ordinations. The monks are freed from observance of interdicts. Crime is forbidden within enclosure. The election of abbots should be free. Oct. 25. Lateran.
