text: Dec. 24. With the agreement of her sisters, Maria, monasterii S. Marie Magdalene in Accon ordinis Cisterciensis abbatissa, records that she has received from frater Guarinus de Monte Acuto sancte domus Hospitalis Iherusalem magister et Christi pauperum custos and his brothers of the Hospital of St John of Jerusalem houses with a platea for a rent, payable each Christmas, of 25 Saracen besants, which will not be affected by any damage that might occur to the houses. The rental agreement has been confirmed in a charter issued by the Hospital of St John. The houses with the platea are situated in the suburb of Acre, in the place commonly called Mons Musardus. On the east they front on to the public way that goes from S. Egidius to the Magdalena. On the south they adjoin the land of Guido de Glia Pisanus. On the west is another public way and on the north they adjoin the abbey of S. Maria Magdalena. At the request of the nuns of S. Maria Magdalena, magister Petrus prior dominici Sepulchri, vicarius domini patriarche, and the chapter of the church of Acre affix their seals. He takes the monastery of Mt Sinai under papal protection, confirming the Rule of St Basil and its possessions. He specifies Mt Sinai and the monastery of St Mary at its foot; the places [loca] called Raboe, Fucra, Liiah, Raython with its palm trees and lands; in the city of Egyptum houses and a casale outside the city; 10 miliaria terrae next to the Red Sea; Faram with lands and palm trees; in Alexandria the obedientia Sancti Michaelis and freedom [of movement] by sea or land; vineyards and olive groves in the Vallis Moysi; houses, mills, vineyards and olive groves at Mons Regalis; houses, vineyards and olive groves at Cracum Montis Regalis; a hospital [hospitale] and the obedientia Sancti Moysi, houses and an oven in the city of Jerusalem; houses and lands at Jaffa; the obedientia Sanctae Caterine in Acre; the church of St George and houses in Damascus, and outside the city 3 virgulta; the hospitale Sancti Demetrii and 3 casalia with villani at Latakia; houses and an oven at Antioch; on the island of Cyprus houses and a [rent] of 1 libra aura from the revenues of the commercium with lands, woods, pastures and mills. He adds freedom from the payment of tithes on lands held before the Fourth Lateran Council and on noval lands, cultivated by the monks and for animal fodder. Episcopal elections should be free. He allows the bishop to absolve those excomunicated or under interdicts. He emphasises that [lay] rights to ecclesiastical benefices or cemeteries are uncanonical. Frederick, secundus divina favente clementia Romanorum imperator semper augustus, Ierusalem et Sicilie rex, draws attention to the favour shown by his predecessors and those of his wife Isabella [II] Romanorum imperatrix semper augusta, Ierusalem et Sicilie regina, to the Hospital of St Mary of the Germans in Jerusalem and praises that Order’s achievements, referring especially to frater Hermannus magister domus and his other brothers. He makes a sealed eleemosynary grant to them. He confirms all their acquisitions in the kingdom of Jerusalem, which has come to him in dowry [nostrum dotale Ierosolimitanum regnum]. The Hospital of St Mary surrendered to King John its rights over properties in this sale that are now in the hands of the Sarraceni. Frederick returns the right to these properties to the Order, so that in future it will hold the entire inheritance of Beatrix from the lands of comes Iosolinus/Iozolinus, except for the assisia in besants from the catena of Acre that the magister and brothers surrendered to King John. Frederick also confirms the eleemosynary grant by Henricus Trecensium comes palatinus, with the agreement of his wife Isabella [I], the daughter of King Amalric, of the barbacan, towers, walls and fosse [in Acre], measured and stretching as far as the Gate of St Nicholas. He confirms King John’s grant of half the booty taken on campaigns on which the king is not present. He extends the privileges of acquiring water, herbage and wood from his domain [in Europe] to the kingdom of Jerusalem, together with freedom from the payment of dues [pro plateatico vel consuetudinibus aliquibus], including those on goods exported to Europe for the Order’s needs, and other rights enjoyed in the West.
