Wintoniensis episcopus, W. Exoniensis episcopus, magister Hospitalis sancti Johannis, magister domus militiae Templi and magister Hospitalis Teutonicorum write a letter for general circulation. They stress their needs, report that the emperor has not crossed to Syria as he had promised and that on the news that the emperor was not coming 40000 returned on the ships in which they had arrived. Almost 800 of the milites who remained delivered the ultimatum that either the truces with the Muslim be broken or they would depart; The dux de Lemburgo, who had been appointed their leader by the emperor, held a council with the Hospitallers of St John, the Knights Templars and the Hospitallers of St Mary of the Germans. The debate was long between those who argued that the truce should be broken and those who said it would be perilous to do so. In the end it was decided to fortify Caesarea and Jaffa during the period before the August passage. The peregrini were called on to be prepared to advance towards Caesarea on 2 November and they enthusiastically responded. Oct. 1-31. Acre. He gives a mill outside the walls of Antioch, situated on the river fer, below the patriarch’s mill, which he had bought and repaired. The mill has 3 millstones [peires] and the Hospital of St Mary of Germans has licence to install a fourth. The mill’s dependencies include a fishery [pescherie]. Bohemond adds the gift of a vineyard, which he had planted near the mill, and the winepress [pressoir] in it. text: Feb. 11. Balianus dominus Sydonis makes a sealed eleemosynary grant to the Hospital of St Mary of the Germans during the mastership of frater Hermannus de Salza. He gives a garden, called the iardinum comitisse, a vineyard and 1 carrucate [ad aratrum unum] of land, part of the terra coci, before the city of Sidon. The garden is bordered on the east by a road leading to Gasia and on the west by a straight road which runs between the gardens and the land of dominus Raulus Januensis. On the south it touches a great field, which is a sugar plantation [magnus campus ubi fit canimel]. On the north it borders the road and the olive trees of dominus Guillelmus de Lye. The vineyard borders on the east the public road [commune strata et publica] and on the west a straight road that goes between the gardens as far as the river that flows by Sidon. On the south are olive trees of the Knights Templar and on the north the olive trees of dominus Brixus. The land has on the east the road which runs from Sidon directly to Sarepta and on the west the coastal road [via maritima]. On the north there is a field which adjoins the garden of dominus Egidius. There is no clear boundary on the south, other than the land’s limits. Balianus also gives a great mahumeria, situated between 2 of the gates of the city of Sidon, from which the road goes to Tyre. text: Mar. 4. Rome. Cardinal Pelagius of Albano rules on conflicting interpretations of his arbitration between the bishop of Acre and the magister and brothers of the Hospital of St John of Jerusalem of 1-31 May 1221. On the orders of the pope, who has intervened, the bishop and frater Rodericus procurator Hospitalis have sought Pelagius’s arbitration, promising to abide by his judgement. (1). The conventual prior and chaplains [prior et capellani] of the Hospital can confer penance, viaticum and extreme unction on those who at the time of their death choose burial in the Hospital, and they can say the Office of the Dead for them, but those who should choose burial with the Hospital in their lifetime are not exempted from the jurisdiction of the bishop and should receive all the sacraments from him and pay their parochial dues, except at the moment of death. The Hospitallers should take care not to persuade with promises, prayers and other means, parishioners whom they receive into confraternity to choose burial with them, but they should leave them to make their own choice freely. Nor should they receive women for Purification after childbirth. (2) The conventual prior and the chaplains of the Hospital cannot advertise in advance certain days specifically or generally on which they will preach to the people. (3) The Hospitallers are forbidden to withhold tithes if a dispute arises with the bishop. Any unresolved issue should be submitted to the judgement of arbitrators or representatives chosen by both parties. The Hospitallers have refused to pay the bishop tithes for the casalia of Beroeth and Coketh. They should not withhold them unless they can demonstrate that the tithes have been remitted by the bishop or that there is some other reason or that there is a legitimate exception allowing them to pay less. (4) The chaplains of the Hospital are accused of carrying away dead persons from the parishes for burial without proving that they had chosen burial with them, in spite of the prohibitions of the parish priests. The dead should be buried at the churches of which they were parishioners unless it can be demonstrated by the testimony of confessors or the wills of the dead, or it can be proved by other lawful witnesses, that they chose burial at the Hospital. (5) Sugar-cane is now grown on some lands which at the time of the agreement of 1221 were planted with wheat or barley. The Hospitallers have been refusing to pay tithes because, according to the tenor of the agreement and custom, tithes are not payable on sugar-cane. Pelagius rules that with respect to those lands which at the time of the agreement were sown with wheat or barley and are now sugar-plantations, the bishop should be paid the tithes he had been accustomed to receive when they were sown with wheat and barley.
