text: Oct. 4. Outside the city of Acre. In the vineyard called Mahomerie, belonging to the Hospital of St John of Jerusalem. The arbitrators P. Cesariensis archiepiscopus, H. Nazarenus archiepiscopus, R. Luddensis episcopus, frater A. Petragoricensis magister Templi and frater G. magister Hospitalis sancti Iohannis Ierlimitani record their judgement in the dispute between E. Nicosiensis archiepiscopus and his suffragans on one side and King Henry and the barones, milites and other homines of Cyprus on the other, represented by I. de Ybellino dominus Berithi, over the payment of tithes and other things contained in the agreements mediated by the late Cardinal Pelagius of Albano [1220, 1222] and confirmed by Pope Honorius III. Failure to observe this judgement will result in a fine of 2000 marchae argenti. The arbitrators decree that to cover the period of non-payment from the date of the agreements to the middle of the following June, the king, barones and other homines of Cyprus, excluding those exiled and disinherited [as a result of the civil war], Queen Alice and those who originally abided by the agreements, will pay the archbishop of Nicosia and his suffragans within 5 years from 1 October 2000 marchae argenti in instalments of 400 marchae a year, paid quarterly. The king will pay a further 1000 white besants [byzantii albi]. The king will give the archbishop of Nicosia and his church the casale or prestria called Mendias with its rustici. The casale will be freed from service [sine servitio aliquo]. After the death of Iohannes Raynel, the church of Famagusta is to be absolved from paying his annual life-rent of 700 white besants, drawn from the casale called Coboche, but will continue to pay 350 white besants to his wife, since this was her dowry [doarium]. The king, barones, milites and other homines of the kingdom of Cyprus are absolved from the payment of other arrears, which had been demanded by the archbishop of Nicosia and his suffragans. The king and the archbishop of Nicosia should seal their copies of Pope Honorius III’s confirmation of the original agreement and exchange them. The archbishop’s copy will be in the care of the magistri of the Hospital of St John of Jerusalem and the Knights Templar until the king’s transcript is delivered. Pope Gregory IX recalls the efforts made over 10 years by the abbas et conventus monasterii Bellimontis, of the Cistercian Order, to recover the casale of Peregus, occupied by W. miles de Riveto. In spite of the interventions of the late Cardinal Pelagius of Albano, the papal legate, and the papacy, the case has not been resolved due to the difficulty of finding judge delegates. The abbey now has possession of the casale, but, although W. de Riveto and nearly all his family are dead, the case is not resolved.
