Pope Innocent IV writes to the master and brothers of the Teutonic Order of Jerusalem, relating that, to avoid scandal, he gave permission to brother Gerhard von Malberg (Malberc), the former master of the Teutonic Knights, to transfer to another order, and the new master gave him 400 silver marks to pay his debts and provide for his needs. In the end, however, the former master wishes to stay in the order and the new master received him kindly, with the former master promising in the pope’s and cardinals’ presence to obey just as other brothers. Believing the former master to be contrite and humbled, the new master, in the presence of the cardinal-priest of Santa Sabina H[ugues of Saint-Cher], granted the former master the bailiwick of Flanders of France and certain other goods of the Order, with the former master asserting that the grant would be null if he did not fulfil his promises and that he wished to live with his conventual brothers. But because the former master neglected to fulfil his promises, creating quite a scandal, which can only be quieted, as is claimed, if the provision is cancelled and the former master lives as a simple brother, especially since the arrangement was against custom. The pope grants the addressees that they can cancel the arrangement as they see fit and subject the former master to their ordinary statutes and procedures if he resists. August 5. Lyons. Pope Innocent IV writes to the patriarch of Jerusalem and papal legate (Robert de Nantes) and the bishop of Sidon, relating that, since the noble man Jean of Avesnes asked the pope to declare him legitimate, the noble man Guillaume of Dampierre, who is affected by the matter, has appeared before the pope, intends to produce some witnesses living in those parts (Outremer) to testify against Jean, and asked the pope to have these witnesses admitted in those parts. The pope orders the addressees to admit within nine months the worthy witnesses to be produced by Guillaume or the agent that he sends there for this purpose, concerning the articles that [the cardinal-bishop] of Porto [Ottone da Tonengo] and the cardinal-deacon of S. Cosmas and S. Damian. Gil [Torres] are sending to the addressees enclosed with their seals. Pope Innocent IV asks the patriarch of Jerusalem and Apostolic Legate [Robert de Nantes] and the bishop of Sidon to calculate the nine months from the time the pope sent the previous letter [8 August 1245, RRR 2509], adding that he does not want the party that first appears in their presence to have to wait more than one month for the other party. If Jean’s party wishes to produce before the addressees witnesses to refute those who were received from Guillaume’s party, the addressees shall receive them within one month and diligently examine them, afterwards sending to the pope their depositions enclosed with their seals.
