In the presence of Matheus canonicus and preceptor Sepulchri Dominici, whose letter of appointment as subdelegatus of the judge delegates the bishop of Lydda (Liddensis episcopus) and the bishop-elect of Bethlehem (Bethlemitanus electus) is cited, frater Bartholomeus de Fossa nova, bishop of Hebron (episcopus Ebronensis), and frater Popus, magister sancte Marie Theuthonicorum, and his convent come to an agreement over properties [in Acre] that the church of Hebron claims were unjustly alienated. The case heard by Matheus is described. The properties are houses situated in the territory of the church of Hebron, in Tauaria in the burgus Montis Musardi, near the church of the Holy Trinity and next to the house of Philippus Tanaor, and a little vulta in the ruga sancte Katherine, which was given to the church of Hebron by dominus Turricus de Oufholt miles and were his legitimately. The church of Hebron has estimated that in the 20 years since the alienation it has lost 3,000 Saracen besants. On the other hand, Frater Gualterius procurator domus sancte Marie Theuthonicorum, representing the magister and convent of the Hospital of St Mary of the Germans, denies Matheus canon of Jerusalem (Iherosolimitanus canonicus) any jurisdiction in the matter, citing privileges from Popes Gregory IX and Innocent IV. Nevertheless, to assure concord, the magister and convent promise to pay the bishop and his chapter 7 Saracen besants each year on the Feast of the Assumption in August.
