text: October 15. Anagni. Pope Alexander IV writes to Patriarch [Jacobus Pantaléon] of Jerusalem, papal legate, and the archdeacon of Acre, stating that it was related in his presence, on behalf of Archbishop [Hugo] of Nicosia, that Pope Innocent [IV] had sent a letter to the archbishop, bishops, and other prelates and rectors of the churches of the Kingdom of Cyprus ordering them to pay a tenth of all their ecclesiastical incomes for three years to Patriarch [Opizo Fieschi] of Antioch for the fortification of Castle Cursarium (Quṣair), naming the archbishops of Caesarea (Cesariensis) and Nicosia (Nicosiensis) as executors. Eventually when the archbishop of Caesarea (Cesariensis) had legitimately committed his charge in this affair to Archbishop [Guillelmus?] of Mamistra (Mamistranus), the archbishop of Mamistra (Mamistranus), asserting that the archbishop of Nicosia (Nicosiensis) did not want to pay this tenth, de facto promulgated a sentence of excommunication against the latter, although he could not de iure, because the archbishop of Nicosia had never committed his own charge in this affair to the archbishop of Mamistra or anyone else. Afterwards, since the same patriarch tried to obtain a letter from Pope [Alexander] to Treasurer [Jordan] Berritensis concerning the fact that the archbishop of Nicosia was to be denounced publicly as excommunicate, the archbishop of Nicosia’s procurator contradicted this letter in a public hearing and obtained from the pope the assignment of Cardinal-Bishop [István Báncsa] of Palestrina (Penestrinus) as auditor for the parties in this business. When the auditor had heard the statements, on the pope’s mandate and with the advice of the cardinals, he declared that the aforesaid sentence of excommunication did not hold de iure and that the archbishop of Nicosia had not been bound by it, as is fully contained in the letter patent written by the auditor and signed with his seal. Therefore the pope agrees to the archbishop of Nicosia’s entreaties and orders the patriarch of Jerusalem and/or the archdeacon of Acre to have announced publicly on papal authority, wherever seems fitting, that the sentence of excommunication does not hold and that the archbishop Nicosia was not bound by it. The pope includes verbatim Cardinal Stephanus’ letter, dated Anagni, 25 September 1259 (q.v.), which the pope already summarized, except that Stephanus reports the claim of Hugo’s procurator that, since the archbishop of Caesarea (Cesariensis) had no authority over his co-commissioner, the archbishop of Nicosia (Nicosiensis), he could not transfer any such authority to the archbishop of Mamistra (Mamistranus).

The archbishop of Nicosia (archiepiscopus Nicosiensis) has appealed to the Holy See against a sentence of excommunication delivered by the archbishop of Mamistra (archiepiscopus Mamistranus), to whom one of the commissioners in the case, the archbishop of Caesaria (Cesariensis archiepiscopus), had transferred his obligations, on the grounds that the archbishop of Nicosia was reluctant to pay the tenth, levied on the incomes of all the churches in Cyprus for 3 years in favour of the patriarch of Antioch by Pope Innocent IV, to pay for the fortification of Castrum Cursarii. The archbishop of Nicosia had not made a formal statement on the matter, but because the patriarch of Jerusalem wished the pope to authorize the thesaurarius of Beirut (Beritensis) to publicize the excommunication, the archbishop of Nicosia (archiepiscopus Nicosiensis) asked for a ruling from the Holy See. The cardinal of Palestrina found in his favour [25 September 1259]. The pope therefore orders the patriarch of Jerusalem and papal legate and the archdeacon of Acre (archidiaconus Acconensis) to have it publicly announced that the excommunication of the archbishop of Nicosia (archiepiscopus Nicosiensis) is invalid.

text: October 24. Ind. III. Acre. In view of the hostile Muslim incursions and the disputes with the Muslim peasantry which mean it is not proving possible to maintain control of their estates, Henry archbishop of Nazareth and his chapter lease four casalia for a period of 50 years to the Hospitallers in the person of the master Hugh Revel. The four are in the place named Batuf: Roma, Rometta, Caphrahusepth and Cana Galilaea. The rent is 2,000 Saracen besants annually payable in two instalments at the end of March and the end of October. In time of war if there are 170 aratra the Hospitallers are to pay the full amount, but if there are between 100 and 170 aratra they are to pay proportionately less and if there are less than 100 aratra they should pay half. Guillelmus, archdeacon of Nazareth and syndic of the archbishop and chapter swears on the gospels to uphold this agreement. The document is sealed with the archbishop’s lead seal and the chapter’s wax seal with the promise that when the chapter has a lead seal it will be affixed. text: October 25. Ind. III. Acre. In the house of the Hospital of St John of Jerusalem. Henry, archbishop of Nazareth, states that although he and his chapter had leased 19 casalia along with their gastine and appurtenances to the Hospitallers for 14,000 Saracen besants payable in October, the master and the brothers fear that the revenues in the first year will be insufficient. At the request of Henry Theotonicus, magnus preceptor in Acre and acting master, he will accept from them what they do receive in this first year. The archbishop is asking Aliottus, the public notary, to make this formal record. Witnesses: Jocelmus, castellan of Mount Tabor, Fr Diaternus, Fr Robertus de Vela; magister Guillelmus, archdeacon of Nazareth. Aliottus Uguiccionis, imperiali auctoritate judex et notarius, composed this document.

At the request of Arnaudus Efforsivius (?), envoy of the commune of Marseilles, Rainerius Zeno, doge of Venice, ratifies the treaty of alliance and friendship concluded at Acre by Laurencius Teupulus the captain and Marcus Justinianus, bajulus Venetorum, on the one hand and Guillielmus Comes, ambassador of Charles, son of the king of France, count of Anjou, Provence and Forcalquier and consul of Marseilles, on the other.
